Autónomo in Spain — is an individual who is officially registered with the tax service and social security system (Régimen Especial de Trabajadores Autónomos, RETA) and conducts independent economic activity on a permanent basis. Such a specialist works in their own name, at their own risk, and with the aim of generating income.
Simply put, autónomo is a self-employed entrepreneur or freelancer who legally provides services or runs a small business without creating a company. This format is used by both Spanish citizens and foreigners who have the right to work. The status is suitable for IT specialists, consultants, marketers, designers, teachers, and small business owners without a complex corporate structure.
Important to note: autónomo is a form of conducting activity, not a type of residence permit.
The basis for residing and working in the country is processed separately.
Main features of autónomo status
The autónomo format has a number of key characteristics:
no employment contract with an employer;
independent invoicing to clients;
mandatory monthly contributions to Seguridad Social;
payment of taxes (IRPF and IVA when necessary);
personal responsibility for financial and legal results of activity.
How autónomo differs from SL (Sociedad Limitada)
Before choosing a form of doing business, it's important to understand the difference between autónomo and SL (Sociedad Limitada) — the equivalent of a limited liability company.
SL is a legal entity separate from the owner. The liability of founders is limited to the share capital, so this form is more often used for scalable projects and large contracts.
Autónomo:
individual;
full personal liability;
all income is considered personal profit;
taxation through IRPF;
simpler administration;
optimal for freelancing and small business.
SL (Sociedad Limitada):
legal entity;
liability limited to capital;
profit belongs to the company;
corporate profit tax + owners' IRPF;
more complex accounting and management;
suitable for large projects and partnerships.
How to register as autónomo in Spain
Autónomo registration includes two mandatory steps:
Notification of commencement of economic activity to Agencia Tributaria (Hacienda).
Registration in the social security system Seguridad Social (RETA).
Registration is possible:
online (with electronic signature);
through personal visit;
through gestoría (tax representative).
Main documents for autónomo registration:
passport or NIE;
residential address in Spain;
social security number;
Modelo 036 or 037 form;
specification of type of activity (IAE);
bank account in Spain.
Which residence permits allow working as autónomo
Autónomo status is used within several types of residence:
Residence permit with right to work por cuenta propia — classic option for freelancers and entrepreneurs;
Digital Nomad residence permit — allows working as autónomo with foreign clients while complying with restrictions on income from Spain;
Family reunification residence permit — in certain cases grants the right to work, including as autónomo;
Long-term residence (larga duración) — after 5 years of legal residence provides free access to autónomo status.
Autónomo in Spain is a convenient and flexible way to legally conduct independent activity without opening a company. However, the format requires understanding of tax burden, personal liability, and immigration rules. For foreigners, the key factor remains correctly chosen type of residence permit, since autónomo status itself does not grant the right to residence.
