For freelancers and entrepreneurs working without an employment contract, Spain offers different legalization options. The two most popular formats are: Digital Nomad residence permit and self-employment residence permit — autorización de residencia por cuenta propia. Both statuses are suitable for those conducting independent professional activities or business, however there are fundamental differences between them.

Below we'll examine the key parameters: income, taxes, validity periods, and processing speed.

Income and Sources of Funds

Digital Nomad Residence Permit

  • A minimum income threshold is established: from €2,600 per month for the main applicant.

  • At least 80% of income must come from outside Spain, meaning from foreign clients or companies.

Cuenta Propia

  • There is no specific minimum income requirement, but it's necessary to prove that earnings are sufficient for the applicant and family members to live on.

  • There are no restrictions on client geography — you can work with both the Spanish market and foreign markets.

Taxation

General tax rules for both types of residence permits are similar:

  • progressive income tax IRPF from 19% to 47%;

  • 21% VAT when working with Spanish clients;

  • mandatory autónomo social contributions.

However, differences arise due to income structure.

Digital Nomad

  • Main clients are foreign, so VAT most often doesn't apply.

  • In certain cases, it's possible to use the "Beckham Law," which allows paying a fixed 24% tax on income up to €600,000 per year.

Cuenta Propia

  • Income is often generated from local clients, meaning VAT is paid regularly.

  • Application of the "Beckham Law" is not possible.

The "Beckham Law" (Ley Beckham) is a special tax regime for foreign specialists relocating to Spain for work, with a reduced fixed rate.

Residence Validity Period

Digital Nomad

  • Initial residence permit is issued for 1 year when applying through a consulate or for 3 years when processed within Spain.

  • After 5 years, you can choose: apply for permanent residence or continue renewing temporary residence.

Cuenta Propia

  • First residence is issued for 1 year, then renewed immediately for 4 years.

  • After 5 years of residence, permanent residence must be obtained. Total absence from the country must not exceed 10 months over the entire period.

Document Processing Times

Digital Nomad

  • Application review typically takes 20–30 days, making this option one of the fastest.

Cuenta Propia

  • The process is longer: on average from 2–3 months to 6 months, depending on the region and workload of authorities.


Digital Nomad is suitable for those who already have stable foreign income and want to obtain residence permit faster with tax advantages. Cuenta Propia is a more universal option for those planning to actively work in the Spanish market and build a business within the country, but requires more time and preparation.
