For this type of residence permit, a pre-contract with specific conditions regarding minimum employment and salary is mandatory.
Who is it suitable for
You have a job offer from a company or individual, but do not yet have a residence and work permit
You have already been working unofficially for 2 years and want to legalize your status through this employer
Employer requirements
Can be either an individual or a legal entity
Must confirm their financial solvency and ability to pay
Must comply with tax obligations and social security obligations
Pre-contract requirements
Minimum employee workload — 20 hours per week
Salary — not lower than the minimum SMI in Spain proportional to hours worked (in 2026 SMI = €1 424,5 gross)
The contract can be indefinite or fixed-term if based on objective reasons (for example, replacing an employee on maternity leave, seasonal work, work on a fixed-term project)

Completed and signed application form EX-10
Copy of all pages of a valid passport (or other identity document)
Documents confirming continuous residence in Spain for at least 2 years (registration/bank statements/medical certificates/certificates from educational institutions/contracts and invoices, etc.)
Certificate of no criminal record issued by the authorities of the country or countries where you resided during the 5 years prior to entering Spain
Employment contract/pre-contract with the necessary conditions regarding minimum employment and salary, signed by the employer and employee
Copy of the employer's tax ID/company charter
Documents confirming the employer's solvency (for example, personal income tax declaration, VAT or corporate income tax/company employment history report (VILE))
Copy of documents confirming professional qualifications in the field of activity or completion of specialized training
Modelo 790 052 receipt and proof of state fee payment
